Your privacy is a crucial factor that Grid Raster, Inc., and its affiliates (collectively, “GridRaster,” “Us,” “Our”) consider in the development of GridRaster’s software, website, products, and web, mobile, or HMD applications (collectively, the “Services”). We are committed to transparency and openness regarding how we collect, use, and protect your information. This Privacy Policy (“Privacy Policy”) explains how we collect, use, share, and protect the information, including personally identifiable data (“Personal Data”), that we gather through our Services. By using our Services, you acknowledge and agree to the terms of this Privacy Policy.

BY USING OUR SERVICES, YOU ARE CONSENTING TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND OUR COLLECTION AND USE OF PERSONAL INFORMATION AS OUTLINED BELOW.   1. INFORMATION WE COLLECT.

1.1.  When you use our Services, GridRaster may collect various types of personal and other identifiable information. Wherever GridRaster collects Personal Data, we make an effort to provide a link to this Privacy Policy.  When you create an account, use our website, purchase our products, or otherwise use our Services, GridRaster collects the following types of information from you:

(a)     Information you provide us: When you use our Services, you provide us with personal information    that include your name and contact information (e.g., email address, phone number, etc.). You may also provide us with payment information, language, and demographics information (e.g., geo-location information). GridRaster also collects content that you create, upload, or receive from others (“User Generated Content”) when using our Services, including communications between you and GridRaster. 

(b)    Information collected during use of services: We collect information about the devices that you use to use our Services. This includes device details (e.g., device type, model, manufacturer, carrier name, crash reports, software installed), data files or similar data structures stored on or associated with your devices, data stored in connection with the device hardware, the device’s operating system, and/or data sent to your devices by GridRaster. GridRaster may also collect usage data or information about your activity in our Services, such as log file information, the number of times you access our Services and the nature of your use, your web request, how you interact with links or features on the Services, the version of our software that you are using, login records, app crash details, information automatically reported by your browser each time you make a request to access our web page or our app, browser type and plugins, failed commands sent out and the status of your set up. 

(c)     Location Information: We may collect information about your location when you use our Services. Location information can include Global Positioning System (GPS) location, Internet Protocol (IP) address, access points, and information collected from nearby Bluetooth Low Energy (BLE) devices.  

(d)    Metadata and Technical Data: Metadata and other technical data associated with any content or information you provide. 

(e)    Cookies and Similar Technologies: Aggregated and anonymized data collected through cookies and similar technologies to improve our Services. 

1.2.  We may also collect non-identifiable data that cannot be used to specifically identify you. This information is collected passively using various technologies.

(i) Non-Identifiable Data. When you interact with GridRaster through the Services, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. GridRaster may store such information itself or such information may be included in databases owned and maintained by GridRaster, affiliates, agents or service providers. The Services may use such information and pool it with other information to track, for example, the total number of visitors to our Services, the number of visitors to each page of our Services, and the domain names of our visitors’ Internet service providers. It is important to note that no Personal Data is available or used in this process.

  (ii) Aggregated Personal Data. In an ongoing effort to better understand and serve the users of the Services, GridRaster may conduct research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and GridRaster may share this aggregate data with its affiliates, agents and business partners. This aggregate information does not identify you personally. GridRaster may also disclose aggregated user statistics in order to describe our services to current and prospective business partners and to other third parties for other lawful purposes.   

  1. HOW WE COLLECT YOUR PERSONAL DATA AND OTHER INFORMATION. 

2.1.  Direct Collection: GridRaster may collect Personal Data that you provide directly to us when you contact us or request information about the Services. By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Data to GridRaster, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of GridRaster and the authorized third parties referred to herein. 

2.2.  Tools for Data Collection: GridRaster may use a number of tools to collect information about you, your computer access points, and the web browser that you use to connect to our Services, such as usage and preference information. For example, we may use cookies and web beacons to collect information and personalize the Services to you. 

  1. Cookies. Cookies are small data files generated by web servers and stored in your computer for future access. We use Cookies for a variety of reasons, including studying visitors’ use of GridRaster websites for the purpose of improving usability. If you choose to visit the GridRaster websites, you do not need to accept the use of our cookies. If you choose to accept the use of our cookies, you may delete them after they have been placed on your computer or your mobile device. You can manage your cookie preferences through your browser settings.
  2. Web Beacons: Embedded in our websites and emails, web beacons help us understand user behavior and the effectiveness of our marketing efforts.

 

  1. OUR USE OF YOUR PERSONAL DATA AND OTHER INFORMATION. 

3.1.  Use of Data: GridRaster uses the Personal Data you provide in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, we may use the Personal Data in connection with the reason for which it was provided. For instance, if you contact us by email, we will use the Personal Data you provide to answer your question or resolve your problem. Also, if you provide Personal Data in order to obtain access to the Services, we will use your Personal Data to provide you with access to such services and to monitor your use of such services. GridRaster may also use your Personal Data and other personally non-identifiable information collected through the Services to help us improve the content and functionality of the Services to better understand our users and to improve the Services. GridRaster may use this information to contact you in the future to tell you about Services we believe will be of interest to you. If we do so, each marketing communication we send you will contain instructions permitting you to “opt out” of receiving future marketing communications. In addition, if at any time you wish not to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us as indicated below. 

3.2.  Additional Uses: If GridRaster intends on using any Personal Data in any manner that is not consistent with this Privacy Policy, GridRaster may inform you of such anticipated use prior to or at the time at which the Personal Data is collected. 

 

  1. OUR DISCLOSURE OF YOUR PERSONAL DATA AND OTHER INFORMATION.

4.1.  GridRaster is not in the business of selling your information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Data with certain third parties without further notice to you, as set forth below: 

(a)     Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets. 

(b)    Third Party Service Providers: GridRaster, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases and processing payments. When we employ another entity to perform a function of this nature, we only provide them with the information that they need to perform their specific function. Additionally, we reserve the right to use third party analytics service providers and advertising partners to collect personally identifiable information about your online activities over time and across different websites when you use our Services, including as described in this Privacy Policy. This Policy does not apply to – and we are not responsible for – those other parties and their use. We encourage you to review the privacy policies of any third parties to learn about your choices about information they collect from you. Furthermore, we partner with third parties to provide certain support services to our users. These third parties are responsible for their own policies and procedures to protect your information. GridRaster is not responsible for the protection or use of information that users provide directly to any third party in conjunction with the use of GridRaster’s Services. This privacy policy only applies to information provided directly to or obtained directly by GridRaster during your use of our Services. 

(c)     Legal Obligations: GridRaster may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of GridRaster, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.

  1. YOUR RIGHTS.

 5.1.  Rights in Relation to Your Personal Data: GridRaster is committed to ensuring that your rights regarding your Personal Data are respected. These rights include the following:

  • Right to Be Informed: Understand how your data is used.
  • Right of Access: Request access to your Personal Data.
  • Right to Rectification: Correct inaccuracies in your Personal Data.
  • Right to Erasure: Request deletion of your data under certain conditions.
  • Right to Restrict Processing: Limit how we use your Personal Data.
  • Right to Data Portability: Facilitate the transfer of your data to another service provider, where feasible. 

5.2.  Data Retention: GridRaster retains Personal Data only for as long as necessary to fulfill the purposes for which it was collected, or as required by law (“Retention Period”). The specific retention period may vary depending on the type of data and the context in which it is collected. For example, we may retain your Personal Data for the duration of performance of its Services to you. After the Retention Period, the User Generated Content or Personal Data may be permanently deleted or anonymized. If you would like your Personal Data deleted once you no longer want to use our Services, please submit a request in writing to privacy@gridraster.com.  

  1. SECURITY.

6.1.  Data Protection Measures: GridRaster takes commercially reasonable steps and generally-accepted technical and organizational security measures to protect the Personal Data provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. GridRaster uses security measures for any personal and account data that we store (e.g., emails, phone numbers, etc.). These measures include encryption, access control policies, regular security assessments, and staff training on data protection. Account-identifiable or user-identifiable data collected through the Services may be encrypted and stored on our internal databases. GridRaster will not sell or transfer account-identifiable data to third parties. Any accessible data associated with your account or your profile can be retrieved only if you provide us with your account identifier. Please be reminded; however, that no Internet or email transmission or data storage is ever 100% secure or error-free and that information on the Services may not be accessed, disclosed, altered, or disclosed. Therefore, we cannot guarantee the absolute security of any Personal Data. Please keep this in mind when disclosing any Personal Data to GridRaster via the Internet.

6.2.  Third-Party Payment Processing: Please note that all payments for products and services are processed by third-parties. GridRaster makes good-faith efforts to use third-party companies which employ proper protections for private information. However, we have no control over said companies; therefore, GridRaster exclusively disclaims any obligation or liability for said third-parties processes and security measures. 

  1. SPECIAL NOTICE TO CALIFORNIA RESIDENTS. While GridRaster may not be directly subject to the California Consumer Privacy Act (CCPA), California residents have the right to file grievances with the California Department of Consumer Affairs at 400 R Street, Ste 1080, Sacramento, CA 95814; or by phone at 916-445-1254 or 800-952-5210; or by email at dca@dca.ca.gov.   2.   INTERNATIONAL DATA TRANSFERS. If you are accessing our Services from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries where our servers are located. By using our Services, you consent to such transfers and processing in accordance with this Privacy Policy. 
  3. CHANGES TO THE PRIVACY POLICY. GridRaster hereby reserves it right to modify/amend or otherwise change this Privacy Policy, as it deems necessary or appropriate because of legal compliance requirements or changes in GridRaster’s business practices. If you have provided us with an email address, we will endeavor to notify you, by email to that address, of any material change to how we will use personally identifiable information.  If you do not agree with our updated Privacy Policy, please do not use our Services.
